Demand for a public inquiry into sales practices at Bell

Canada_Bell_

“Bell delivers the highest quality to our customers on-time and within budget. Bell’s performance is driven by experienced on-site management, the best trained craftsmen in the industry and a workforce focused on safety and quality.

“The call to hold a public inquiry into sales practices at Canada’s major telecommunications service providers is growing, on the heels of more allegations of wrongdoing inside the industry.

Two consumer groups — OpenMedia and the Consumer Council of Canada — say they support a call earlier this month by the Public Interest Advocacy Centre (PIAC), which urged the federal telecom regulator to investigate high-pressure sales tactics by telecom employees.”

A “technical support” employee working for Bell at a third party call centre in Orillia, Ont., that’s owned by Nordia wrote to say he’s frustrated that he’s expected to push a service called “Bell Tech Xpert” even to customers who need help fixing something as simple as connecting to their home Wi-Fi.

Employees from both Bell and Rogers retail stores have also contacted Go Public, describing managers’ unscrupulous tactics they say are used to get them to push products that customers don’t need and often can’t afford.

They write about being encouraged to hide fees attached to products, tack on services that aren’t requested, and to prey on people who seem vulnerable — including low-income and older people — to hit sales targets. ”

Many Bell customers are on a limited income, and selling some of the company’s products to such people who clearly cannot make use of them isn’t a concern for the “higher-ups.” It’s a lot like those scammers who prey on the elderly.

Bell’s shareholders’ happiness is the most important thing  for them in the whole world. Out of the big 3, Bell is the most aggressive on selling products to customers. It is like  dealing with a salesman from a car dealership. It’s always, the deal ends soon, buy now! or bundle your services to save more!  A too common travel agent , real estate practise too.

No one should think that the bad press that Bell gets because of stories like these will encourage them to change their behavior. . The way they do business based and the consumer complaints   is unlikely to change the way this company behaves.  The Canadian government should do something about this as it is unacceptable that Bell is allowed to get away with bad, poor, immoral behavior like this.

THE KETTLE  CALLING THE POT BLACK,  BELL ONE OF THE BIGGEST LIARS, ALONG WITH OTHER THIEVES WANTS JUSTICE.. HA HA HA

A Coalition that includes Bell, CBC, Rogers, Quebecor Inc  and Cineplex wants to end illegal streaming of content, urge CRTC to establish agency to help locate piracy websites, to locate and shut down websites that are portals for illegally obtained video and audio content,  have banded together to create FairPlay Canada.

.

They want to forbid  access to TV shows, movies and music from websites that don’t pay for the content that they stream to consumers, should lower their own prices first. They first should get their own houses in order, stop the lies, false misleading advertising, bribes, kickbacks and pirating software themselves.   ” Groups who steal and re-sell content without permission are breaking the law “. and so do they as well..

.

More recently, the companies used a strategy to target TVAddons, a Canadian-controlled website  in which the telcos used a civil search warrant (known as an Anton Piller order) to access the home of Adam Lackman, a Montreal man who owns the site, as well as the copyright issues in the case. Their actions are documented    which chronicle abusive conduct that included hours of interrogations without the ability to consult a lawyer along with efforts to obtain new evidence (as opposed to preserving existing evidence).   A  judge’s findings indicate that the telcos went far beyond acceptable conduct in their efforts to shut down the sites.

They now want   the Canadian Radio-television and Telecommunications   commission to use its power as a regulator to require Canadian internet service providers to shut down access to the pirated material. They also want the CRTC to set up an independent agency to help locate the pirate websites.  Critics expressed concern about a lack of court oversight in deciding which websites would be banned  and the suppression of a free net. “It will undoubtedly lead to legitimate content and speech being censored online, violating our right to free expression and the principles of net neutrality, which the federal government has consistently pledged support for.” The proposal “would essentially create an official internet censorship committee within the federal government, and open the door for overreaching censorship in Canada.”

Bell, BCE own profitability..

The departure of Nortel Networks Corp.’s CEO, a once proud flagship of Bell,  and most of its board marks the effective end of the 124-year-old company. But the remarkable aspect is that Nortel lasted as long as it did, given its rapid descent from national hero to national disgrace.  “I knew when I joined the board it was high-risk,” said Harry Pearce, who stepped down as chairman Monday after four years as a Nortel director. The litigation lawyer – a former chairman of Hughes Electronics and a former vice-chairman of General Motors – said he was under no illusions when he came on board in January, 2005, after a major accounting scandal had pushed Nortel close to the brink.  “Pearce an ex-General Motors executive – there you go, Nortel hired a blind man to lead the blind. And Nortel’s failure is not due to external factors as he states (poor economy, meltdown in capital markets, blah, blah, blah), rather it was p$$$ poor management, fraudulent accounting, etc. I don’t see any of Nortel’s competitors having problems staying afloat, in fact they all seem to be prospering in these trying times.”  http://www.theglobeandmail.com/globe-investor/ambition-gave-way-to-a-harsh-reality-pearce-zafirovski/article1246625/

“During the dot.com rush, senior BCE management embarked on a scheme to turn the company into a multi-media, converged entity. To do this they stripped Bell Canada – the telephone company – of people and used revenue formewrly used to upgrade the network, to buy the Globe and Mail and the CTV television network. They failed to support the infrastructure to compete with the cable companies. But the dazzle in their eyes was caused by the almost mythical idea of multi-media empires delivering content to homes throughout North America on phone lines. It was a great idea except they forgot they were still running a phone company and that the infrastructure needed to be upgraded FIRST. It was like putting a $50,000 bathroom in a house with old windows and a leaking roof. Today, Bell has a patchwork network, with the best service in the major urban centres (high-speed internet and cell coverage), while smaller markets make do with less. Bell has been bleeding hundreds of thousands of customers for several years, service has fallen and, as I mentioned, it is patchwork quality, depending on where you live.  In the corporate boardrooms incompetence seems to pay. Jean Monty, former CEO, raked in millions when he left in shame, and I can hardly wait to see Sabia’s nice little package when he turns the lights out.”  http://wordylefty.wordpress.com/2007/06/26/the-ugly-demise-of-bell-canada-june-26-2007/

It seems that Bell, BCE continually now faces bad news about it’s own profitability..

Needless to say greedy Bell and the others had expected to gouge all if it’s customers, old and new  forever as well but things rarely go as expected especially for Bell for the customers are not stupid. Bell’s promises of future revenue increases  and improved great services based on their past performances to date also are not valid, reliable. It seems the Zebra too still cannot change it’s stripes. http://www.theglobeandmail.com/report-on-business/recessionary-dip-or-permanent-decline/article1244199/

Canada’s largest wireless companies are now clearly wrestling with their first real decline in smart  phones customers’ monthly spending, and wondering if it is a sign of the times or a harbinger of the future. “The companies have spent billions to deploy networks and are stocked with fashionable smart phones. But even as Canadians snap up the latest handsets and sign three-year data contracts, operators are seeing average revenue from each customer fall. Is the drop a result of the recession, or does it reflect the more competitive landscape that is about to see even more players enter the field? BCE’s Bell Canada said yesterday that it generated 4 per cent less money on average from its wireless customers in the last quarter, compared with a year earlier. That follows similar news last week from rival Rogers Communications Inc. , which reported a drop of more than 2 per cent. Today. The downward trend of what the industry calls ARPU – for average revenue per user – is significant for Bell, Rogers and Telus because they rely on wireless as their engine for growth.  As part of its second-quarter financial report, the company said it signed 45,000 new wireless customers in the period, compared with 83,000 in the second quarter of 2008. In addition to the fewer new accounts, Bell said ARPU fell $2.22, to $52.05 a month. Both results fell short of analysts’ expectations and crimped BCE’s overall performance, with profit dipping 4 per cent and sales down 2 per cent. “People are actually using the product less in the economy, from a voice perspective,”  “A decline in employment means a declining use in wireless and we are seeing that. BCE executives agree that tougher competition, especially among their discount brands, is a factor. But they say it is being offset by customers’ adoption of new data services, which generated 28 per cent more revenue in the quarter from a year earlier.  A key step involves cutting costs, which BCE has done by eliminating several thousand jobs over the past year. Executives said it has also improved quality of service, eliminating many customer calls. General and administrative expenses were down 11 per cent in the quarter, which helped bump gross margins up to 40 per cent. Other steps include the recent purchase of the 50 per cent of Virgin Mobile Canada Bell didn’t already own; the acquisition of electronics retailer The Source and its 750 stores nationwide;  and a more aggressive branding campaign. In addition, the company is building a new national wireless network on the leading wireless standard of the day, called HSPA. Bell is sharing the development costs with Telus and both companies   expect  to launch service on it by year-end.  Bell TV turned in the best performance of the quarter, with video revenue rising 9 per cent to $389-million.

Meanwhile , Bell Canada is taking the federal broadcast regulator to court to stop the country’s big networks from charging cable and satellite companies for their TV signals. Bell, which owns Canada’s largest satellite service, known as Bell TV, alleges in documents filed with the Federal Court of Appeal that the broadcast regulator has overstepped its jurisdiction and has asked a judge to intervene. The move comes after the Canadian Radio-television and Telecommunications Commission said in May it would let large conventional networks, such as CTV and Global Television, negotiate with cable and satellite carriers on compensation for their signals. The court filing is unorthodox, since it is extremely rare for a company to challenge the CRTC so directly. The bitter debate has driven a wedge down the middle of the broadcasting industry in Canada, and these court filings demonstrate how contentious the issue has become. There is already tension between Bell Canada and CTV, the television network in which Bell owns a stake, and this case will only increase it since the two sides could meet in court. Bell owns 15 per cent of CTVglobemedia, which is the parent company of CTV and also owns The Globe and Mail.  Paul Sparkes, CTV executive vice-president of corporate affairs, also reserved comment. “As the matter is before the courts, it’s not appropriate for us to comment on the substance of the appeal,” he said. “We are confident that the Federal Court of Appeal will see this for what it is, a stall tactic.” ” Interesting how Bell fought very hard and successfully to get the feds to bring in laws against people who use “black boxes” to take Bell’s satellite signals without paying. Now Bell wants to take the network’s signals, without paying for them, and then charge customers for these signals. Seems very inconsistent to me! ”  http://www.theglobeandmail.com/report-on-business/bell-takes-tv-fight-to-court-to-escape-regulators-squeeze/article1243859/

It is no surprise to me that mobile companies are overpricing their wireless internet services so that only businesses can afford this service.  A wireless spectrum auction last year attempted to improve competition but there is still lots of work to be done. Most mobiles available in Canada come locked to a multi-year contract  http://healthinformaticist.wordpress.com/2009/06/09/oh-canada-isp-censorship-and-internet-slippage/

Who can you trust when it comes to money?

Filed under: News and politics — thenonconformer @ 5:55 am

Hey I cannot even trust the local store clerks to  charge the right price on anything I  buy and anything still, for the  advertised price and the price on their computers often still differ now too.. and some clerks just try to charge me often  even twice for the same items so they can put more money into their own pockets. Who can you trust..  not the business world.

80 percent of U.S. businesses are overcharged on their phone bills while telecom companies reap profits from the supposedly “accidental” billing errors ”When Alexander Graham Bell placed the first phone call to Thomas Watson, it is doubtful he was considering whether he would be overcharged for the call. Many American businesses have the same attitude, and it’s just easier for them to trust that the phone company is charging the correct amount than scrutinize each item on the bill.. few take the time to have someone look over the bill for errors. The problem comes from the long-standing system phone companies use to track their services and billing. The system is split into two sections: The section that keeps track of what services a customer has, and the section that bills the customers. “It’s quite often the case that there’s faulty entry between the two systems, which results in faulty billing.” “The process itself is inherently faulty,” Billing errors have been occurring since the dawn of telecommunications, and certain phone providers can be almost relied on to make trademark mistakes, because, invariably, those kinds of errors are repetitive; they happen quite often,”  It is in the phone companies’ interest to allow these mistakes to be made..some companies, especially the older, more established ones, can give him some bureaucratic static when he is trying to recover his clients’ money. “You can go for weeks and months just trying to get to the right person that you need to talk to, because one person sends you to another person, who sends you to another person,” he said, but that’s not he only obstacle a customer faces. “It’s quite often the case that a vendor will say, ‘Well, it was on your bill. Why haven’t you ever noticed it before?’ Well, the fact is that it should never have been on my bill to begin with.” A consumer may be paying a bill, and if they suddenly see an extra $5 charge, most assume it’s a surcharge and pay the bill without thinking about it. The reality is that the charge could have come from a feature used by anyone in the customer’s area, or data could have been entered into the billing system incorrectly. These small charges add up over the course of service, so  recommends keep  a close eye on your bill, and not pay  for anything you’re not using. Ignorance and complacency are two big obstacles for companies and phone users to overcome before they can save money. Many do not think to check their bill, and few realize just how much money they are giving away over the course of their service. It is a good idea to take the time to look over your bill for mistakes. Just don’t rely on the phone company to do it for you. The overcharging problem is rampant across all aspects of telecommunications ” This also applies now to Bell Sympatico as well as I have clearly detailed before..

Just do an internet  search of Sympatico, thenonconformer. As simple as that too.

Control Freaks

Too often in life now to my own surprise I have been given orders, mandatory commandments by control freaks clearly too as to what I should do, like not make any negative internet posts too,  by some of the bad relatives of mine, bad news reporters, even bad cops, bad politicians and it often now made me wonder why did they   wrongfully still do  think that God has made them a slave master over me.. boy they were in for a rude awakening next when I refused to do what they had said.
.
By the way the most read posts of mine do tend to be the firstly personalized ones, where I do  clearly, loudly to all  and rightfully tell the truth, express  my own views.. such as
 .
If you are a   Control freak you are not only still unrealistic, immature, immoral person  but you  may have a serious personality disorder.  Even if you are self employed or  work for Bell Sympatico.
  .
You are a menace, plus a real danger to yourself and to others, for you are an abuser, a human rights violator too.
 .
Having clearly now an exaggerated emphasis of your own self importance, being totally in  control is part of a cluster of behaviors that can be labeled as compulsive and generally characterized by perfectionism, orderliness, workaholic tendencies, an inability to make commitments or to trust others and a real cover-up for your fear of having your own flaws exposed. You are exposed now still too..
  .
All  these type of Persons who  believe they can protect themselves by staying in control of every aspect of their lives, or of others, including their relationships are idiots, fools, grossly in error, in need of professional help, good pastoral counseling.
 .

I rightfully  believe in the right of free speech, mine, yours, everyone else’s and not solely yours.

.

Most all of you have had to contend with control freaks and they are found everywhere, in Corporations, at  home, in churches too.. These are those people who insist on having their way in all interactions with you. They wish to set the agenda and decide what it is you will do and when you will do it. You know who they are – they have a driving need to run the show and call the shots. Lurking within the fabric of the conversation is the clear threat that if you do not accede to their needs and demands, they will be unhappy.. and they will delete your post…

.

While in reality God has made us all equal, and GAVE US ALL MOUTHS WE CAN SPEAK WITH, EARS TO LISTEN, it seems some people, in churches, on the net, elsewhere, they  still wrongfully do think they are better than others, or want to dominate others, do try to give orders to others, do try to make rules for others  that they too often themselves do not follow too, they are in fact still bullies..  and now why is that? and who do they think they are now that they are so special? Mere fools. They mostly have a hidden agenda, they are falsely seeking fame, power, control, a position of prestige, for they are immoral slave drivers trying to walk on the back of others…

.
I really do love now all my wordpress blogs for they not only do  they allow me to exercise my own right of free speech, and allow my right to be heard by others too now
 .
I have already mentioned it to you rightfully and often too  before that I often get letters from some persons telling me what I can and cannot write on their sites, rather them wanting to write all of my posts too it seems. Many disturbed persons are now disturbed by the contents of my posts, so these  ostriches try to find a false excuse not to deal with it, and try to instead falsely delete it. The control freaks  emotional stakes includes their own identity and sense of well-being. Being in control gives them the temporary illusion and sense of calmness, a false feeling of superiority. and what fools they are when in reality they are so far from it now too.
 .

Control freaks or Bullies, abusers, wrongfully do cause  others stress so they can maintain a false sense of order. These people themselves firstly are are still riddled mostly with anxiety, fear, insecurity, and anger. They’re very critical of themselves their lover and their friends, but underneath all that still too that supposedly perfect outfit and great body is a mountain of real unhappiness, unresolved guilt, disturbed person.

.

Certainly, it’s natural to want to be in control of your life. But when you have to be in control of the people around you as well, well you have gone crazy, become a fool, a demonic controlled person who can’t rest until you get your way and you are headed down a very bumpy ride, it is easier to try to control yourself, and impossible to control all the others.

.

(1 Cor 9:27 KJV)  But I keep under my body, and bring it into subjection: lest that by any means, when I have preached to others, I myself should be a castaway.

Beware always of men and women, bullies, tormentors, control freaks,  persons, civil and public servants,  politicians, pastors, leaders, elders, who falsely do, will try to enslave you, oppress you, exploit you even while they claim they are proclaiming the truth, democracy, trying to help you, etc.,

.

Is 51:23 ..your tormentors {and} oppressors, those who said to you, Bow down, that we may ride {or} tread over you; and you have made your back like the ground and like the street for them to pass over.

.

Someone had the mistaken idea we all do still need to be kind to these bad wolves in sheep clothing, the perverse oppressors, these human rights abusers.. dream on.. them being put into jail is the sole kindness they rather do deserve.

.

Is 55:7 Let the wicked forsake his way and the unrighteous man his thoughts; and let him return to the Lord, and He will have love, pity, {and} mercy for him, and to our God, for He will multiply to him His abundant pardon. 8 For My thoughts are not your thoughts, neither are your ways My ways, says the Lord. 9 For as the heavens are higher than the earth, so are My ways higher than your ways and My thoughts than your thoughts.

.
Is 56:10 watchmen are blind, they are all without knowledge; they are all dumb dogs, they cannot bark; dreaming, lying down, they love to slumber.

.

The need to control is almost always fueled by anxiety – though control freaks seldom recognize their fears. At work, they may worry about failure. In relationships, they may worry about not having their needs met. To keep this anxiety from overwhelming them, they try to control the people or things around them. They have a hard time with negotiation and compromise and they can’t stand imperfection. Needless to say, they are difficult to live with, work with and/or socialize with.

 .
Is 57:4 Against whom do you make sport {and} take your delight? Against whom do you open wide your mouth and put out your tongue? Are you not yourselves the children of transgression, the offspring of deceit–
 .
So “Those who demand the most often give the least.”  Ask them to send you something or do something for you. By asking something of them, you will be indicating that you are not intimidated or diminished by their behavior patterns. In order to not feel degraded, humiliated and have your sense of self and self worth assaulted, you need to avoid being bulldozed by a controlling lover, boss or friend. When you are caught up in a truly destructive/controlling attachment, the best response may still also still be to expose them and call the police and walk out.
.
The WRONGFULLY STILL Unrepentant  bully’s problem is that he or she is one of those bad persons  who only feels truly alive when voicing hostility and contempt for his “enemies.” Without that, he or she starts gasping for air. It’s his nature.. self-destructive” ..  clearly these immoral  Bully, Basher of others, Abusers of others has a disappointed, deflated ego, negative self worth,  most likely related to past unresolved guilt, as a result  of  that   the bully, he or she, tries falsely to   build  their ego up by bashing, hating others, by being an antagonists against  his proclaimed enemies, which too often also  is most people , for  he or she no longer trust anyone, and Abusers this is a common very typical approach, fact in the character build up of Bullies, Bashers, but their approach is futile, the subsequent feeling of self worth dissipates too quickly, are actually replaced by guilt,  and his ego, self worth likely needs to be recharged with new hate.. and is replaced with more and larger hatred of the others.  I have seen this type of wrong behavior not just in bad managers, bad politicians, bad persons, but  in alcoholics, and most often in Albertan rednecks ,but also  in religious   fundamentals evangelicals who promote hated towards Pentecostal Christians as well, and  now as well as the crooked pastor wrongfully  fighting for control over others. Public exposure and prosecution of these bad persons here too services everyone’s best interest.
 .
IT IS NOW MORE  RARE BUT I DO ALSO NOW STILL GET BULLIED BY RELIGIOUS BULLIES, ABUSERS TOO..  not just by the past too many bad cop, politicians too…
 .
Here also is what I at least have found amazing about real life, the amount of evil, wrong doings does depend on the actual places you go to. In Canada I toonow have found some cities are worse over others. I have also found that some banking institutions, governmental offices  are better over others. The same truth applies to hospitals, schools or what ever. Needless to say all this depends on the local management styles, policies or actually too often the lack of it.
 .
Isn’t nice that according to the Canadian Charter of rights I too now can write to absolutely now any one I want to  still, all news editors, all politicians too,  and that if they  do not want to read my emails they  can just delete them too.. or they  can first take their  email of the net and stop requesting people to write to them. I would have thought that they too  knew that by now too.. funny.. What do any of them still think they or you are the only one who can tell, write and post the truths even on the net still? and the rest of us cannot?
 .
It seems you cannot trust the federal or the provincial, municipal  governments in Canada still..  do  we all do these days too do keep on getting media revelations of abuses, corruptions, lies etc..   https://thenonconformer.wordpress.com/2010/02/11/toronto-councillor-adam-giambrone-lies/
 .
I do also  have to say I was amazed so readily myself. How in my last few decades of Canadian experiences how quickly the too apparent crooks it seems are the first ones who threaten to or do  sue, even how they do try to shut up the truth from the public exposure, a subject that I  have often written about..
 .
Our governments and the courts clearly are firstly very slow to enforce prosecutions of the really clearly bad persons such as the bad cops, bad civil and public servants, too many tax evaders, thieves, tax payer’s money abusers    and undeniably as well but what the very apparent crooks can too readily sue the others.. ..  falsely can attempt to suppress, obstruct  justice from being carried out?
 .
And there are  still too many for my liking in Canada  crooked professionals such as even crooked realtors, bad Real estate firms, bad Accountants, bad lawyers, bad Pastors and priests now too, bad cops, bad medical workers, bad civil and public servants, too many tax evaders, even too many  bad telecommunication, internet firms guilty of false, misleading advertising and customer abuses too such as Bell.. https://thenonconformer.wordpress.com/2010/04/13/the-way-normal-business-is-supposedly-being-carried-in-canada/
 .
Hey I admit life has thrown me some really big surprises, things I had not expected to encounter:
– One surprise for a start was as to how crooked most Canadian evangelical pastors often are, they are mostly still sinfully human, and they do need to become real practicing Christians firstly. .
.
NEXT I WONDERED WHY THE RELIGIOUS, CHURCH BOARD MEMBERS WERE SO DEAD OR SLEEPY HEADS, USELESS, FOR THEY DID NOTHING GOOD ABOUT THE BAD THINGS THEY TOO FOR CERTAINLY NOW SAW..  I next realized they had taken their positions not to make real positive changes but mostly to become more well like by others, to be more popular, to have more friends, even business contacts too, and thus if their making any of the needed changes can cause you to lose your popularity now, your friends and make a lot of enemies too, they do nothing good about it.
.
So if you want to make a big difference in life do not expect to be well liked, or very popular too. Nobody likes to be rebuked but As many as I love, I rebuke and chasten: be zealous therefore, and repent. (Rev 3:19 KJV)  Open rebuke is better than secret love.(Prov 27:5 KJV)  Faithful are the wounds of a friend; but the kisses of an enemy are deceitful.  (Prov 27:6 KJV)
.
Now about the too many crooked churches who teach false doctrines and claim to be Christians, you now clearly, always for a START can tell who the false  professing Christians persons  they really are by their clear visible lack of love for others, and how quickly they can divorce the others who do not give into their pockets, or go along with their false demands now too,
.
– NOW THE CHURCHES THEMSELVES WERE, NOT BY THE LEAST, THE ONLY PLACES I ENCOUNTERED TOO MANY CROOKED PERVERSE PERSONS. ALSO JUST TRY THE BUSINESS WORLD, THE CIVIL AND PUBLIC SERVICES, GOVERNMENTS, THE POLICE INCLUDED NOW.. I was again really surprised here too as to why no one did basically about these perverse persons, false teachers, crooked persons, and I guess they were just as crooked as they were firstly. Lying, thieving, alcoholic, abusive  priests, pastors, Ministers, cops, LAWYERS, DOCTORS, PROFESSIONALS  who cannot even change themselves for the good  they are of no use to anyone as well. I do not have to accept any of those lying hypocrites who say to me you cannot judge me for I am a good person .. dream on.. I can. http://postedat.wordpress.com/2009/09/01/they-are-of-no-use-to-anyone-as-well/
.
– Next I could not but notice the many troublesome, perverse, meddlesome persons  I also do encounter, have encountered elsewhere  in real life, especially in family members, relatives,  but also in professionals, lawyers, associates, etc..
.
NOW I TEND TO WRITE FROM WHAT I KNOW IS TESTED, TRIED, AND TRUE.. SUCH AS ALL THAT GLITTERS IS NOT GOLD FOR SURE TOO.
.
Now I once worked at a poorly managed firm for a few years and wondered why the General Manager did nothing about it too.. and I next wondered how best to deal with it as well.. One day a few years later  they fired the General Manager and it next shook up the rest of this staff and everyone started to work harder, so I learned a great lessons, if you want to make changes, you have to start making  exemplary changes at the top, openly firing first the incompetent mangers.
.
And  I had learned now that public exposure, real negative exemplary consequences to the major bad persons works well.. the darkness hates the light and runs away once exposed..   I am not kind at all rightfully to any abusers, verbal ones, physical ones, etc. that I too do encounter..
.
Did you know that sibling rivalry, abuse is one of the most common forms of family violence? Siblings will use physical violence because they have learned it from their parents, a bad mother or a bad father,  or other adults. In fact, one study found that 76% of the children who were repeatedly abused by their parents also abused their siblings.. and their spouse next too http://postedat.wordpress.com/2008/12/28/coping-effectively/
 .
MY DENTIST EVEN TOLD ME THAT too many persons ARE  frustrated, angry at work, but they cannot get back at the people there who hurt them, so they come home and take it out falsely, abusively on their family members instead. Unacceptable too.
  .
Almost since my first job after graduating from university I had learned that generally most people still are not to be trusted, they always do need to be supervised, and corruption still exists in construction, universities, municipalities, governments, corporations, amongst professionals and politicians as well. Here is what I know for sure in Canada that the proper policing, management , supervision human rights commissions are a real fact of life, in our society, in schools, life, in churches, governments, commerce, institutions, civil and public services, professional services too, and elsewhere, even on the net, for you will always have those 30 percent at least of the persons who will try to cheat, lie , steal, bend the rules, falsely believe they are above the laws. Self regulation alone is too often pretentious, farcical, often not applied as well. That applies especially to the professionals, civil and public services, police, municipalities, politicians, pastors now as well.
.

You can fool most of the people most of the time, some of the people some of the time but not all of the people all the time.. nevertheless a good name is worth more than any silver or gold you acquire, and a bad name is disrespected even after the person’s death. One of the most surprising things to me in real life was to witness, experience. and many times now too, that the real bad, immoral con men, liars, thieves, fakers, imposters, pretenders do often like to be associated with a Christian Church .. and can hold positions as Pastors, elders now too..

.

One of many real life examples, from my childhood days in my local Church I had now encountered a fellow evangelical church attendee, who next years later was eventually arrested for possession of stolen property and for a time went to prison for it. It now next was of course a shock to hear next that this same person years later when he left prison had became an ordained evangelical Pastor. A shock cause there was no real evidence in fact that he had even changed.. Now decades later the same person now claimed to be a chaplain, visiting sailors on ships, and was supposedly conducting church services. The same person had become the owner of various store buildings and apartments, and he also owned and ran an antique shop as well. I next happened to rent one of the apartments from him as well. Upon which I clearly had discovered, often had witnessed that he still was a fake, for he now also was involved in tax evasions, welfare fraud as well. He used his position as a Church chaplain to buy medals, uniform, war souvenirs from visiting port sailors and next to resell them in his antique store for cash even. He in fact had not changed at all, he was still a crook.. So excuse me when now someone claims to me that such and such a person is now a really good person. In reality I rightfully next tend to first check it out firsthand, for rightfully I no longer believe what most people tell me

.

(Mat 5:13 KJV) Ye are the salt of the earth: but if the salt have lost his savour, wherewith shall it be salted? it is thenceforth good for nothing, but to be cast out, and to be trodden under foot of men.

.

(Luke 6:43 KJV) For a good tree bringeth not forth corrupt fruit; neither doth a corrupt tree bring forth good fruit. 44 For every tree is known by his own fruit. For of thorns men do not gather figs, nor of a bramble bush gather they grapes. 45 A good man out of the good treasure of his heart bringeth forth that which is good; and an evil man out of the evil treasure of his heart bringeth forth that which is evil: for of the abundance of the heart his mouth speaketh.

Do you really also practice tax evasions too? is this why you find my writings so offensive? RSVP

I have asked nicely. Please take me off your list. Otherwise I will contact our security department and have you blocked. Thank you.

 > Isn’t nice that according to the Canadian  Charter of rights I can write to absolutely now any one I write still and that  if you do not want to read my emails you can just delete them too.. or you can  first take your email of the net and stop requesting people to write to you. I  would have thought that you knew that by now too.. funny.. What you think you  are the only one who can write and post the truths even on the net  still?
One of the most corrupted institutions that I have found in Canada for decades excluding the police and governments  specifically were too many of the  churches even in Montreal. The reason  is very straight forward and it is that these institutions are not real practicing religious centers but rather nationalistic, cultural or social groups. I have shockingly heard people many people form these institutions say to me they have been going to church for 50 years or more, but they now do not believe that God exists, or it is not a proven fact there is any life after death. So why were they going there now still?
.
Undeniably on top of that here too money is the root of all evil, and so is the too common tax evasions and personal abuses, human rights violations   here in these same places too. Tax evasion is a fact of life, many persons here in these churches did, do work under the table, they do not declare all of their incomes. And if the pastor is a bad person so how can I next expect the members of his flock to be great ?

Bell bites back with poor-man’s iPhone Globe and Mail – 3 Jul 2008 BCE Inc.’s lengthy struggle to privatize may have left management distracted and Bell Canada’s brand reliant on a couple of aging beavers, but the phone company is still managing to strike back at its more nimble rivals.

Ever wonder besides viruses that as time goes by you notice that   your computer net is slower, and slower, well it is no secret Bell, Rogers, and others cannot handle the continually increasing demands caused by computers and iphones now too. So their systems break down too often, have too many failures often, are over used, in over capacity mode.. and these carriers seem to  have been to cheap to rectify the problem, update, modernize their communication equipment..    https://thenonconformer.wordpress.com/2009/06/14/buyer-beware-beware/

The stastics on my own sites do show that MY MANY POSTS ABOUT MY UNDENIABLE EXPERIENCE WITH BAD BELL SYMPATICO ARE STILL ON THE TOP 3 MOST POPULAR READINGS OF ALL OF MY VARIOUS TOPICS THAT I HAVE POSTED ON MANY SITES OF MINE.

I had already written months ago  even here that Bell was capping the Sympatico downloads EVEN cause it was making way for their iphone business and Bell will definitely abuse it’s phone customers the next same way it has undeniably now too  abused many of it’s ISP customers. Sad and unaccepatable.

Too Many major ISP suppliers are unacceptably guilty of

Too Many major ISP suppliers are unacceptably guilty of initial and subsequent false misleading advertising practices, and an immoral  “Bait and switch” business   practice as well.

Here is the undeniable reality.. Many bad ISP corporations beforehand do not disclose the amount of capping that they do to their customers., or after wards, or lie as to much they supposedly cap. For example I have a Bell Sympatico connection or I can use a second party proxy connection, and next I get twice the download speeds with the proxy over the Bell’s capped services even  during the non peak hours as well, such as all day Saturday.. not just  evenings  4.0 pm to 2. am when Bell admits it caps their lines. Now that is a fact any potential bell customer should know now too.

“AP  Sun Jun 15, 9:45 AM ET  At one time, the word “unlimited” meant unlimited.

Sprint’s mobile broadband service is the latest to abandon the term and the principle in favor of a monthly cap designed to keep their heaviest users from overwhelming their network.

But Sprint isn’t alone: its two 3G competitors also cap usage, and two wireline broadband operators are testing explicit caps as well. In the earliest days of broadband, service was either heavily capped, with ridiculously low limits–I recall DSL plans that had 1 GB monthly downstream limits for business-grade offerings–or totally uncapped.

Now, the idea of capped service with metered rates, stern warnings, or cancellations above a monthly limit are fully in fashion. For the last few years, companies like Comcast and Verizon’s wired broadband division have warned users about excessive downloads, degraded their service, or canceled their accounts, often with little recourse, and sometimes denying it all the while. Enough states’ attorneys general and FCC staff and commissioners have been involved that what was implicit has become explicit, but with the related effect that caps have become much lower than what they were in the ad hoc days before these changes. Driving all this is not scarcity, because there’s plenty of headroom out there on the Internet, but two interrelated issues: service providers always dramatically oversell their service, and some users are actually abusers. ( But really how can one be an absuer when he pays for and uses what was advertised now?

On the first issue, if an ISP has 500 people connected to a central office DSLAM (a DSL aggregator) with a total downstream bandwidth of 2 Gbps, there’s no universe in which a phone company makes available 2 Gbps to that location. Rather, they allot a fraction of that, which works when traffic is bursty, not continuous. Many people downloading or streaming a lot impact everyone in the same grouping. (I’ve seen this at home when I complained about my 3 Mbps DSL dropping to 500 Kbps at night. A Qwest technician explained I was lumped with heavy users, and with about 20 minutes of waiting on the phone, regrouped my line to another, less used pod of users, and my service has been fine since. The nice part is that was a logical change; no one had to walk over to a cage and move my wires around.)

The second issue has provoked a lot of debate. But without explicitly labeling the limits on a service, a subscriber can’t technically abuse it. If you know when you sign up for Comcast that they limit your use to 10 GB and provide tools to monitor as well as an understanding of what that bandwidth would allow you to “consume” each month, it’s a very different matter than “all you can eat. “

Verizon had long promised unlimited Broadband Access for their 3G EVDO mobile broadband service. But it was well documented that unlimited had fairly strict limits. After an investigation by the New York attorney general’s office, Verizon agreed to change its disclosures, pay some costs to the state, and refund money to some subscribers. The company now fully discloses its 5 GB per month limit for combined upstream and downstream data. Verizon charges you 49 cents per MB ($490 per GB) when you cross that limit, and the company says that they use email, SMS, and a live data usage display in their connection manager to keep you apprised. Note that a single high-definition movie download might consume nearly 5 GB.AT&T, likewise, has a 5 GB cap each month on LaptopConnect, its 3G cell data offering, with unspecified behavior when you top that amount–additional charges may apply, but clarity would be helpful. They note in their PDF-only terms and conditions: “The parties agree that AT&T has the right to impose additional charges if you use more than 5 B in a month. Prior to the imposition of any additional charges, AT&T shall provide you with notice and you shall have the right to terminate your service.”Sprint has joined this club with first the leaked news and then official confirmation that starting July 13, 2008, its 3G service would also have a 5 GB cap. A spokesperson told me that off-network roaming–ostensibly with Verizon or Alltel, the only other major providers of 3G in the US using the EVDO flavor–is capped at 300 MB per month. Now these are all 3G providers, who have limited spectrum over which they have to make sure all contending users in each cell get approximately the same kind of experience. They can’t afford one user sucking down all bandwidth. However, we’re seeing the same kinds of limits start to be tested for cable-based broadband.

Comcast is testing delaying traffic–slowing down packet transmission to throttle the bandwidth rate–in two Eastern cities they cover for the heaviest users of their service. This is an effective cap, rather than a cutoff. (Comcast has been delaying BitTorrent P2P traffic for all its users prior to this; this change affects all traffic, not just BitTorrent, and is being announced, instead of sub rosa.) In a town in Texas, Time Warner Cable is experimenting with offering different speed packages each of which is coupled with a monthly limit on usage. The lowest-priced package offers a ridiculous 768 Kbps downstream and 1 GB per month for $30 per month; the highest-priced is 15 Mbps downstream with a more reasonable 40 GB per month limit. Charges are $1 per GB above that. With cable companies traditionally and telephone companies newly offering television programming, premium channels, and on-demand video, the caps are another tool to prevent competition from over-the-Internet sources of things to watch. In a situation in which a few carriers control all the pieces, it’s unclear whether rate caps can stick. If both telcos and cable companies decide to impose such limits and restructure their networks, who do you turn to? People with broadband are unlikely to cancel it. In a monopoly or duopoly market, you can’t switch brands. There has to be a happy middle–a role that the FCC may help to negotiate. A 40 GB cap switched to 400 GB might serve precisely the right purpose without penalizing average users who have no other market choice. With Time Warner Cable charging a buck a gigabyte above their monthly limits in their test market, but with Amazon’s S3 service delivering it retail for as little as a tenth that, it’s not hard to see that carriers are looking to caps to solve network problems and make a little scratch on the side.”  http://news.yahoo.com/s/pcworld/20080615/tc_pcworld/146752

Verbal abuses.. Much too common these days

(Prov 21:9 KJV)  It is better to dwell in a corner of the housetop, than with a brawling woman in a wide house.

Bullies, abusers, liars, slanderers tend to be clearly immoral persons who try to enslave others uancceptably even if they profess to be Christian or what ever,,

>>My ex-husband smokes pot and drinks a lot, and I am told, so does his girlfriend. He once told me that I am too righteous because I don’t drink or do drugs, and I attend church.

and that was a verbal abuse if I have ever seen one..

so do thank God daily that he has now removed your from this  abusive relationship..

and do ask Him, God  to take all the tears away and he will.

(Psa 4:8 KJV)  I will both lay me down in peace, and sleep: for thou, LORD, only makest me dwell in safety.

(Rev 21:4 KJV)  And God shall wipe away all tears from their eyes; and there shall be no more death, neither sorrow, nor crying, neither shall there be any more pain: for the former things are passed away.

and there still can be a good life after divorce with God’s help…

Truly any type of abuse is unacceptable and anywhere too

and exposing it loudly in public as well as calling the police is the best way to deal with it for everyone’s benefit, the abuser included.

God himself clearly does not accept verbal, physical, or human rights abuses

(Mat 18:6 KJV) But whoso shall offend one of these little ones which believe in me, it were better for him that a millstone were hanged about his neck, and that he were drowned in the depth of the sea.

(Mat 18:7 KJV) Woe unto the world because of offences! for it must needs be that offences come; but woe to that man by whom the offence cometh!

(Mat 18:8 KJV) Wherefore if thy hand or thy foot offend thee, cut them off, and cast them from thee: it is better for thee to enter into life halt or maimed, rather than having two hands or two feet to be cast into everlasting fire.

No we ALL cannot STOP, take the ostrich approach under the guise of love to the definite bad acts of others, we as Christians are still called to be fruit inspectors of those who profess to be Christians ESPECIALLY WHEN THEY RARELY QUOTE IT in actual context OR LIVE THE BIBLE THEY CLAIM THEY BELIEVE IN-

(Gen 31:42 KJV) Except the God of my father, the God of Abraham, and the fear of Isaac, had been with me, surely thou hadst sent me away now empty. God hath seen mine affliction and the labour of my hands, and rebuked thee yesternight.

(Lev 19:17 KJV) Thou shalt not hate thy brother in thine heart: thou shalt in any wise rebuke thy neighbour, and not suffer sin upon him.

(Neh 5:7 KJV) Then I consulted with myself, and I rebuked the nobles, and the rulers, and said unto them, Ye exact usury, every one of his brother. And I set a great assembly against them.

(Psa 119:21 KJV) Thou hast rebuked the proud that are cursed, which do err from thy commandments.

(Prov 24:25 KJV) But to them that rebuke him shall be delight, and a good blessing shall come upon them.

(Prov 27:5 KJV) Open rebuke is better than secret love.

(Eccl 7:5 KJV) It is better to hear the rebuke of the wise, than for a man to hear the song of fools.

(Mat 17:18 KJV) And Jesus rebuked the devil; and he departed out of him: and the child was cured from that very hour.

(Mark 1:25 KJV) And Jesus rebuked him, saying, Hold thy peace, and come out of him.

(Mark 4:39 KJV) And he arose, and rebuked the wind, and said unto the sea, Peace, be still. And the wind ceased, and there was a great calm.

(Mark 8:33 KJV) But when he had turned about and looked on his disciples, he rebuked Peter, saying, Get thee behind me, Satan: for thou savourest not the things that be of God, but the things that be of men.

(1 Tim 5:20 KJV) Them that sin rebuke before all, that others also may fear.

(2 Tim 4:2 KJV) Preach the word; be instant in season, out of season; reprove, rebuke, exhort with all longsuffering and doctrine.

(Titus 1:13 KJV) This witness is true. Wherefore rebuke them sharply, that they may be sound in the faith;

(Titus 2:15 KJV) These things speak, and exhort, and rebuke with all authority. Let no man despise thee.

(Heb 12:5 KJV) And ye have forgotten the exhortation which speaketh unto you as unto children, My son, despise not thou the chastening of the Lord, nor faint when thou art rebuked of him:

(Rev 3:19 KJV) As many as I love, I rebuke and chasten: be zealous therefore, and repent.

“This is from the book by Patricia Evans http://andthenshecried.wordpress.com/2008/02/05/the-verbally-abusive-relationship-how-to-recognize-it-and-how-to-respond

Verbal abuse is a kind of battering which doesn’t leave evidence like physical abuse does. However, it can be just as painful, and recovery can take much longer. The victim of abuse lives in a gradually more confusing realm. In public she is with one man, in private he becomes another. Often, for the verbally abused woman (man), there is no witness to her reality and no one to understand her experiences. Friends and family continue to see her ex, the abuser, as a really good guy and, certainly, he agrees with them. The verbal abuser, while maintaining his charm with others, always takes his abuse behind closed doors. It is a means of holding power over his wife( husband) /partner.. Many women and some men leave a marriage and come back into the singles’ world with the diminished self-esteem that comes from a verbally abusive relationship. The fact that many of these women (men) have never even realized that they were being abused, makes it easy for them to enter another abusive relationship. A verbal abuser is an insecure person and immature person who is looking for power and control over another. In order to help you recognize abuse, remember that all forms of verbal abuse are methods of manipulating you for the purpose of establishing power over you. The following are some of the forms of verbal abuse the author helps you recognize.

  1. Withholding: a purposeful, silent treatment.
  2. Countering: a countering of your ideas, feelings, and perceptions, even going so far as to refute what he misconstrues you to have said.
  3. Discounting–a putdown of you or something you hold dear.
  4. Blocking and diverting–this is a sneaky, covert way of violating your dignity.
  5. Accusation and blame: generally involves lies about the partner’s intentions, attitudes, and motives. The author states that accusation and blame is present in all verbally abusive relationships.
  6. Judging and criticizing: lies about your personal qualities and performance.
  7. Trivializing and undermining: abusive behavior which makes light of your work, your efforts, your interests, or your concerns. The abuser attempts to dilute meaning and value in your life. Undermining might occur when your partner laughs at you, for example, when you burn yourself cooking. It is also jokes at your expense. Undermining is occurring when you feel a “so-called joke” is mean rather than funny.
  8. Name calling: no one has a right to call you degrading names. Name calling is verbal abuse.
  9. Ordering: Telling you to do something, rather than asking, or making decisions for you or for the two of you without your input.
  10. Forgetting and denial: the trickiest form of denial is forgetting. Become aware that forgetting is a form of denial that shifts all responsibility from the abuser to some “weakness of mind.”
  11. Abusive anger: this seems to be closely linked to the need to “blow up,” to dominate, to control, to go one up, and to put down. Any time you are snapped at or yelled at, you are being abused.
Threatening: Physical threats and sexual threats aside, verbal threats are an effort at manipulation. For example, a threat to leave, stay out all night, or take you home immediately is a manipulation for power. The threat of “pending disaster” is designed to shatter the partner’s serenity as well as her boundaries.

If you counter the abuser or attempt to explain yourself, you will probably be met with such statements as, “I don’t want to hear it, get out of my face” or “Woman you don’t have the brains“, “BYou shouldn’t have said that to me“.

If you are in a brand-new relationship and see warning signs of verbal abuse, the author suggests you might be wise to let the relationship go. It is not likely that a man (woman) who needs to dominate and control will change easily, if at all. It is also likely that when the newness of the relationship wears off, he will become more abusive. Verbal abuse can become physical in time and physical abuse is always preceded by verbal abuse, according to Evans. If you are in a long-term relationship, you can respond to the abuser as the book suggests and soon discover for yourself whether or not your mate is willing to change and stop his abusive behavior.

“If you have been verbally abused in your relationship, you may have discovered that explaining and trying to understand have not improved your relationship. Therefore, I recommend that you respond in a new way–a way that will make an emotional, psychological, and intellectual impact upon your mate.”

The abuser in your relationship may change when he finds that you do know when you are being abused, that you have set limits, that you mean what you say, and that you will not take behavior you don’t like.

If the man ( or sadly too often now a women) in your relationship remains abusive, it is not only not your fault,” it is  your responsibility to deal with it, make it public, call the police too.

Any person cannot still fight with you of you leave his or her presences, even forever.. and there is still a good life after a failed marriage now too. I practise what I preach and often now too.

The first spouse, love seems  is always the best one in our false pride.. and I know what that is like too.. WE SEEM ALL TO REPEAT OUR BAD TASTE, VALUES.. When they let a person out a prison they generally have a rule not to let them return to his old environment, past home, for five years.. otherwise they will be under the same old bad habits, dispositions too..

NOTE I lost once everything I had owned.. still next I replaced it all with the same things, even though I never used most of them, old habits and bad tastes DO die hard still too for almost all of us..

Now still reporting publically the abusers, and calling the POLICE TOO most often solves the abuse problem the best.. for if the evil persons do not feel real negative personal consequences, REAL negative public exposures, they really have no reasons to change their bad habits next and likely then never will.

I rightfully too tend to openly expose all abusers, all bad people, all bad churches, all bad politicians, all bad corporations that I come across, and  often and I  also do do call the police, regulating authorities  often and demand they all be fired,   be put in jail too.

I was also still surprised how popular this post now is too.

To be fair the judge should first go after the major pornography watchers on the net, for what now the  Hollywood movie piracy is more of an immoral act over watching pornography? or will the judges do that next and get a list of the  porno users too? and what next? Home and more privacy invasions too!! Unbelieveable

Employee shot and killed a supervisor..

“An employee shot and killed a supervisor and four others after an argument at a western Kentucky plastics plant, then turned the gun on himself, police and a company official said Wednesday.”

And if we delude ourselves to think that we Canadians are not so violent, gun crazy too, yes we too have had our share of revenge killings in Canada, even employers, killing some of some of the bad persons who likely asked for it no matter how tragic basically now their deaths are.

I do not believe in violence, for  me the pen still is really mightier than the sword, and a good reputation is worth more than silver and God.

I clearly do believe in the right of everyone to speak, to speak out as well,  and to be equally heard by all, so we can all judge what has been said if it is appropriate and we can next corresponding act upon it, even in the church, in the government, on the internet now too. Clearly some people falsely DO DISALLOW THIS RIGHT… the bad persons especially as even I know this for sure. They respond with a personal attack, inquisition, censorship, lies, slanders, diversions, distortions, instead of facing, dealing with the facts, truths being presented. Confirming to many what they still are really like, immoral, abusive bullies.

I can relatedly say that too me the federal public and civil services, cops, RCMP inluded, related commissions  are all mostly or merely a farce,  pretentious  now still  for the most parts from my many past many dealings with them now too. Just do  Log a complaint about misleading advertising, sales and service abuses  by a corporation, or an abuse by your employer,  or about being falsely discriminated, or you being abused on an internet site, or someone  threatening to kill you for being a whistle blower or what ever, etc., and most of the time you will get back in reply rather lies, distortions, falsehoods and no valid actions..  But next that certainly does not stop me from pursing justice.

Now for many years I have done my share of blogging and I encountered too many abusers, bullies, liars on the net in secular and religious sites, some detailed at http://postedat.wordpress.com/, and I rightfully did not put up with them quietly even if they were from Alberta, or anywhere else too.

So if I do next want to rightfully get back against a really abusive, unrepentant person  even now  I merely deal with them in writing eventually telling even to all about his or her actual deeds, acts, reputation, image, and I do this very effectively too. Most persons,  Canadians tend not to support the crooks, the bad guys, the visible losers once publicly exposed still nor should they now too. Nor does the news media generally  next too.  I do thus first clearly write to him and to the others next about him, and I do not shoot him. That might haven been kindlier.  Rather I let the whole world know what he is really like, and what he did,  as I had witnessed it myself, and I cannot be sued  now for slander if I am telling the truth too,  and the lawsuit would even bring more bad publicity on the bad guys still too.

I have seen many persons next in shock, depression, ill even once next fully exposed too.. Church pastors and their wives especially, as well as many Professionals now too.  They had many chances before to stop their wrong doings, to repent already too. But they had  liked to gamble that they can next still get away with it.. and sooner or later that approach backfires, it even makes matters worse. I have even the news media on my speed dial too. So should we all.

Honest public exposure and prosecution of the major guilty persons serves everyone’s best interest..

Prov 24:25 KJV)  But to them that rebuke him shall be delight, and a good blessing shall come upon them.

(Prov 27:5 KJV)  Open rebuke is better than secret love.

(Eccl 7:5 KJV)  It is better to hear the rebuke of the wise, than for a man to hear the song of fools.

(Rev 3:19 KJV)  As many as I love, I rebuke and chasten: be zealous therefore, and repent.

(Luke 17:3 KJV)  Take heed to yourselves: If thy brother trespass against thee, rebuke him; and if he repent, forgive him.4  And if he trespass against thee seven times in a day, and seven times in a day turn again to thee, saying, I repent; thou shalt forgive him.

Hanging Up on Early-Exit Fees

One of the most common Questions I still do get from nay persons is how do I break a contract for breach of services.. https://thenonconformer.wordpress.com/2008/04/27/basic-contract-law/

“Hanging Up on Early-Exit Fees Regulators and courts are taking aim at early-cancellation penalties charged by carriers such as AT&T, Verizon, and DirecTV

There may be 50 ways to leave your wireless carrier. Just don’t do it before your contract is up—or you’ll be forced to pay a fat early-termination fee. That’s the lot facing most U.S. consumers of communications services, from mobile calling to cable TV to high-speed Internet access.  Consider the subscriber who wants to end a DirecTV (DTV) service contract and has to pay $20 a month for the remainder of the term. Breaking a wireless services contract can cost as much as $175. It’s a big reason why few people switch communications providers. At satellite TV company DirecTV, only 1.42% of customers close their accounts each month. Even Sprint Nextel (S), with one of the highest customer defection rates in the wireless industry, loses a mere 2.45% of its customer base in a month.

A prorated approach? But in a move that could make it easier for customers to drop phone or satellite providers, early termination penalties are coming under new fire from federal regulators, legislators, and courts. The Federal Communications Commission (FCC) has scheduled a hearing for June 12 to consider potential restrictions on the penalties. And even if the FCC doesn’t act to rein them in, Congress is mulling legislation that would.

Cable and phone companies, which spend hundreds of dollars on advertising and promotions to sign up each new subscriber, fear they’ll have a harder time recouping that investment if the penalties are diminished too far. And exit penalties exist worldwide: European telco Vodafone (VOD) requires subscribers to pay their monthly fees for the duration of wireless contracts, even if they don’t use the phone.
FCC Chairman Kevin Martin has suggested that the commission may require service providers to prorate penalties through the life of a contract, so that the longer a customer stays, the lower the fee. The agency may also require that buyers be allowed to drop a service such as a new cell phone contract without penalty within 30 days of purchase. “Certainly carriers may be able to recover legitimate out-of-pocket expenses and costs,” says FCC spokesman Robert Kenny. “On the other hand, we want to make sure this isn’t being used as an artificial means of locking consumers into a particular service provider.” A ruling to alter the allowed penalty structure could come as early as this fall, says Carol Mattey, a former FCC official who is now a managing director for consultancy Deloitte & Touche.

“Enormous Pressure” Congress, meanwhile, is considering several bills backed by powerful supporters, including Edward Markey (D-Mass.), chairman of the House Subcommittee on Telecommunications & the Internet, and Senator Jay Rockefeller (D-Va.). The measures, proposing conditions for wireless contracts similar to those being considered by the FCC, are already going through revisions in Congressional committees and could be passed in early 2009.  But while the FCC and Congress may impose restrictions, it’s the legal system that threatens to scratch early termination fees altogether. Courthouses from California to New York are flooded with class actions claiming that early termination fees, especially those on wireless contracts, are unfair to consumers. In a landmark ruling on May 27, the Supreme Court refused T-Mobile USA’s request to dismiss one class action based on the cellular company’s contract stipulations that all customer disputes be settled through arbitration. The decision means that all similar suits can proceed—some state courts are expected to decide cases within days—and may open the floodgates to new class actions. “I just see an explosion of lawsuits,” says Mattey. “Every week, every carrier is getting sued. It’s going to create enormous pressure.”

To preempt state court rulings, T-Mobile and Sprint Nextel have already announced they will start reducing early termination fees as the time remaining on a contract declines. Exact details haven’t been disclosed, though the changes are expected to take effect this year. Just two days before the Supreme Court decision, AT&T (T) announced it would reduce its $175 early termination fee by $5 per month through the life of a new contract. That matched a policy implemented last year by Verizon Wireless, which has also introduced a 30-day risk-free service trial and now allows customers to switch calling plans without starting a new contract.

Sprint’s Vulnerability The industry would rather make the changes on its own. “Early termination fees are changing based on consumer demand,” says Joe Farren, spokesperson for CTIA, The Wireless Industry Association, noting that consumers can always opt for pre-paid wireless services that don’t require contractual commitments.

But carriers’ moves may prove too little too late. Lawsuits alone could result in billions of dollars in costs and settlements, and may prompt providers to axe early termination fees altogether. “Pandora’s box is going to open up,” says Jessica Zufolo, senior policy director for telecommunications, media, and technology at Medley Global Advisors.

For an industry that has long used contracts to keep subscribers on board, elimination of termination fees could spell massive changes, such as higher churn and slimmer margins. A satellite TV company typically spends around $700 to recruit a consumer. For wireless companies, the cost of acquiring customers, including marketing and handset subsidies, is closer to $400, and it typically takes more than a year to recoup. Higher rates of switching could be especially nettlesome for Sprint Nextel, which regularly finishes near the bottom of customer satisfaction rankings. “The biggest loser, unfortunately, in this space is Sprint,” says Serge Matta, senior vice-president at ComScore (SCOR).

A Dash of Kindness An industrywide, free 30-day trial period would provide cold comfort to wireless providers. The provision would make it easier for a certain percentage of subscribers to start hopping from one provider to another to get free service. Back when long-distance companies abolished contracts, a material percentage of consumers began switching without paying their last bill, says Rich Nespola, CEO of consultancy TMNG (TMNG).

To keep subscribers, more wireless carriers might follow Verizon Wireless’s lead and begin allowing subscribers to switch to lower-priced plans without having to extend contracts. A recent survey of more than 2,000 users by ComScore showed that 19% of Americans switched to their current carrier for a better price. Carriers may also offer users more free content and other incentives to encourage them to stay. “They’d do sweet things instead of barbs,” says Richard Doherty, director at consultancy Envisioneering Group. But these treats are likely to eat into revenue and margins.

One potential beneficiary of lower termination costs: equipment manufacturers. Today, an average American replaces a cell phone every 17.7 months, vs. every 16.6 months in 2006, according to consultancy J.D. Power. That lengthening replacement cycle spells trouble for handset makers Nokia (NOK), LG, and Motorola (MOT). If early termination fees go away completely, handset sales could jump 25% in the first six months, Doherty estimates.

A downside: To preserve their margins, service providers may not subsidize the equipment as much as they do today. Sure, subsidies are becoming less common, and less of a draw for consumers willing to splash out upwards of $500 for a razzle-dazzle smart phone. But, unable to charge termination penalties, service providers may simply pass the cost to consumers as other fees.

Having your ISP or others instead cancelling your services is easy.. Just continue to post on the net the truth as to what they are like.. and your services won’t be worth anything to them next, they will disconnect you gladly..”

” The ISP suppliers, Canadian corporations  now even such as Bell, or Acanac Inc. http://www.acanac.ca 1-866-281-3538  still are big unacceptable Liars who undeniably too are  clearly  guilty also of misleading, false advertising too now.. Accanac had mentioned on their internet  site that they do not cap their downloads.. but they conveniently had forgot to also say to all of the potential customers on their site that they lease their services from Bell and   that Bell itself  still regularly between 4 pm to 2 am caps their downloads.. when confronted with this they  Acanac Inc do reply  that  they do not cap their downloads but Bell does.. what an absurd misleading play on words. Mind you Acanac headquartered in Toronto did also claims that  they do provide a solution to this Capping software by means of a Putty software but unfortunately this  Acanac Inc approach is unreliable, requires continual monitoring, and is presently   more problems then what it is worth. Acanac’s support services are also non basically existent in fact, or very very inadequate, slow…So why does our pretentious , inadequate Minister of industry, Jim Prentice MP and his   useless consumer affairs department fail over and over again to look after the good interest of the consumers, but looks mainly after Big business good welfare?”

My past download and service problems with Bell Sympatico,

 bellcanada

I must say I am still rightfully really unhappy with my past years of experiences with my  Bell  Sympatico ISP services , their DSL Service and  DSL modem included.  I had joined  Bell Sympatico  because they  had advertised to me,  a high speed, unlisted, unlimited downloads and with no capping of their downloads. And had I known beforehand that I would have all of the many  unacceptable problems with them, and I would also also have their RATHER poor support on all of this  next to, plus their dishonest billing, management practices too, I really would not have bothered to GET THEIR  Internet services even  initially ..

But the way the Bell customer support services tended to poorly handle my rightful complaints was ridiculous next as well. They had mislead me often as to what the real problem was, it was bad poor Bell itself, their inabilities  to meet theor own  promised contract terms. (Prov 27:2 KJV)  Let another man praise thee, and not thine own mouth; a stranger, and not thine own lips.

Bell Sympatico undeniably clearly had beforehand promised me verbally a “high speed unlimited, uncapped, reliable, continual download services,  and not they will try to next to  offer me this, submit  their best service but they had, have  to deliver to my next what was promised.  In reality they had clearly failed to live up to their own advertisement, promises because of their in incapableness now to do so to me and often as I had witnessed even for 24 months and rightfully detailed, had complained to them too.  Bell, their false pride of self importance has gone to their head and has allowed also the employees, even the president of Bell, vice president of Bell Sympatico to wrongfully now be abusive to  me ,  to wrongfully think that they can dictate their  own contract obligations, terms now to others, to wrongfully make their own self evaluations too, and that the others, like me, have no choice but to comply even to their clearly lies, distortions, perversities. The Bell president himself now also needs to be reminded that a contract is a joint agreement amongst two equal, mutually submissive  parties, and that both parties have to respect the contract agreement, and each other, meaning definitely that Bell has to respect the customer now too.. When this immoral Bell perverts now even writes to me and says according to our own records we have adequately supplied your our services, that is a disserted one sided fact, not necessarily or rightfully shared by the customer now, me. I have dealt with another ISP and they were more honest as to what they had promised me and next delivered in comparisons to Bell Sympatico  now too. The Bell competitors  download speeds are significantly higher all the time as well,  with no capping too  and even cheaper too.

I knew that there was something wrong with my Bell Sympatico ISP cause when I had started to measure it their internet download speeds and their the torrent download speeds fluctuated , were low and  the torrents were also capped by 90 percent   between peak times 4 pm till 2 am by Bell Sympatico  which was  all absurd,  the torrent download speed  was as slow as   15 kbs and not  rather what I had by Bell in  in the past of 250 to 350 kbs as well during peak hours. Bell for 6 months had lied to me and said the problems were related to my own computer and software when it next turns out undeniably this was never so too.  Bell Sympatico next  was unable in  18 months to resolve my problem, they replaced my modem 7 times, sent me 7 repairmen to my home as well.. and yet in one day my new ISP,  DSL supplier was able to resolve it.. Not only was Bell Sympatico  not delivering to me regularly their promised high speeds on their high speed internet, but I was also having major  internet connectivity site problems and email problems and too often, and I was unable to concurrently use my torrent downloads, email software, and my internet browser. It was all  getting to be so unacceptably absurd too. Bell wrongfully, clearly  had not lived up to it’s promised  contractual obligations.Bell Canada Inc. has been ordered to publicly disclose information that details the level of congestion on its network in regard to a dispute over the company’s internet speed-throttling practices.

The Canadian Radio-television and Telecommunications Commission on Thursday told the company it has until June 23 to make public data that was marked confidential in a May 29 filing. Bell had said it needed to keep quiet the information, which details the level of internet traffic and possible congestion on its network, for competitive reasons.

In a letter sent to Bell, CRTC director general of competition, costing and tariffs Paul Godin said the need for public disclosure outweighed the company’s competitive privacy concerns.

“Commission staff has determined, based on all the material before it, that no specific direct harm would likely result from disclosure, or that the public interest in disclosure outweighs any specific direct harm that might result from disclosure,” he wrote. (link)

Bell Sympatico itself next had did me a great favor by cutting off my poor services with them

but Acanac had next offered an effective solution for it..  and also very much cheaper as well, all at the same speeds too.. “Acanac Residential High Speed ADSL without any Limits  No Blocked Ports or Traffic Shapping, Unlimited Downloading 100 GB of Online Storage Up to 5 Mbps Download and 800 Kbps Upload  $18.95 per month  This offer is only available on a 1 year term and the first year of service” sales@acanac.com<sales@acanac.com>

Upon further advice from the net
I set my Torrent  settings to:
-16 kBps upload instead of 60 kbs or more
-500 kbs (not unlimited download)
-tcpip.sys patched to 50 connections
-I do  have firewall disabled,
Now I’m even downloading with 400 kbs and yes… the torrents I do use are selected do have many seeds and few peers.. so I am sure I can reach the maximum speed.

I like to use the torrent to download TV shows especially , I found TV shows often much better than the  movies, resolution included, plus on torrent downloads there generally are no COMMERCIAL interruptions,  and  I can chose when I want to watch the programs as well and this is why I basically do not want the cable TV instead.. I no longer watch my TV not even for the news.. since I also prefer to use the net for my news now too where I can get it at any time I want to  too..

I have let the putty program, with your recommended setting of 60 run all night, when it seems to be the most critical period, and it worked well.

I have much appreciated your help and support here..

and I have been able to use my torrent download, and my email, plus my internet explorer with no connectivity problem.

Now with steady confidence I can continue to recommend others to use Accanac as well.

I wish all the problems of life could be resolved that easily too.

Thanks a lot.

The MS operating system was  made for multitasking, even on the net, but with Bell Sympatico I clearly, wrongfully was unable to do this as well. Bell had even recommend that I shut down my  torrent software when I wanted to use my email or browse the internet. And  yes I too was really upset to find out that Bell was still capping my bit torrent downloads.. email, etc.,,
