Bell, Sympatico – Customer’s profiles

  
One of the most disturbing thing about Bell Sympatico, besides the fact they are big liars, who do not disclose the full truth to the customers before or after,  is the issue of the customer’s individual Service profile continually reset by Bell itself.. and the customer’s profile varies with customer to customer,   it is critical too for  it determines the customer’s actual internet download and upload speed that Bell next delivers to the customer. I am sure Bell will use this same approach with their iphones service now  too. While all residential customers may pay the same amount for a high speed download service from BELL in reality they do not even get the same download and upload capacities.

“My internet connection has been re-profiled 4 times that I know of since I signed up. On initial installation I was getting a 3 meg profile. I submitted a support ticket via the Acanac website and was pleasantly surprised to have my connection re-profiled to a 4 meg connection. That lasted 2 weeks then Bell re-profiled me to a 2.5 Meg connection. That was infuriating so I submitted another ticket to have my connection re-profiled. I put that ticket in 2 months ago and my connection has gone from bad to worse. Recently I was re-profiled again down to a 1.7 meg internet connection. I have sent 3 emails about my connection and every time Acanac ( my sub contractor of Bell ISP) support tells me they will look into it or they say a tech will come out to fix it but nothing ever happens.”

What is a Profile, and why does Bell use profiles? Bell clearly is unable to meet all of the promised, advertised  customer speeds, customer’s demands in many areas , even  in big cities too, because their line capacities are overcrowded, inadequate, or the lines have not been properly upgraded. So they Bell use their own determined profiles to set limit on the individual customer to hopefully be able to balance their own internet service supply lines.. so you can see why Bell and their lying spin doctors falsely oppose any regulations  for themselves.
 
FULL ACCOUNTABILITY AND TRANSPARENCY SHOULD APPLY TO BELL  new as well, not just to Stephen Harper, and his too many past unkept promises in this area now as well.

    Bell Sympatico undeniably clearly had beforehand promised me verbally a “high speed unlimited, uncapped, reliable, continual download services,  and not they will try to next to  offer me this, submit  their best service but they had, have  to deliver to my next what was promised.  In reality they had clearly failed to live up to their own advertisement, promises because of their in incapableness now to do so to me and often as I had witnessed even for 24 months and rightfully detailed, had complained to them too.  Bell, their false pride of self importance has gone to their head and has allowed also the employees, even the president of Bell, vice president of Bell Sympatico to wrongfully now be abusive to  me ,  to wrongfully think that they can dictate their  own contract obligations, terms now to others, to wrongfully make their own self evaluations too, and that the others, like me, have no choice but to comply even to their clearly lies, distortions, perversities. The Bell president himself now also needs to be reminded that a contract is a joint agreement amongst two equal, mutually submissive  parties, and that both parties have to respect the contract agreement, and each other, meaning definitely that Bell has to respect the customer now too.. When this immoral Bell perverts now even writes to me and says according to our own records we have adequately supplied your our services, that is a disserted one sided fact, not necessarily or rightfully shared by the customer now, me. I have dealt with another ISP and they were more honest as to what they had promised me and next delivered in comparisons to Bell Sympatico  now too. The Bell competitors  download speeds are significantly higher all the time as well,  with no capping too  and even cheaper too.

    1- Why is it you Sasha Rollins wrongfully had never returned my phone calls to you this year in 2008, the last time we talked was before you went away for your Christmas holidays. This clearly was very unprofessional of you too. 
     
    2- Why is it when you had agreed in December 2007 the 6 months free unlimited internet in 2008 to compensate that you Bell had previously lied to me and had next not only had not delivered my paid for high speed system the last two previous years, but now next you had undeniably not delivered it to me in 2008 . How stupid do you take me to me, what kind of a fool now? For even the next promised reliably or steady service, rather in 2008 it only worked well one week out of 4 weeks in every month of 2008 as I had detailed and I had in writing rightfully complained to you now too.. Bell, you should compensate me for the poor system you had delivered me previously and also now as well for 2008 and that was why I had asked a total compensation rightfully from you in 2008 for 2500 dollars as detailed to you in writing this year now too…
     
     3: I had asked of you many times for signed invoices for my monthly Sympatico billings for all of 2008 and I had not received it, finally you had sent on incomplete invoices, partials to me, and next you Bell you had refused to explain, deal with the clear unacceptable discrepancies on the monthly 2008 invoices that I had often by phone, in writing, on the net had detailed to bell Sympatico as well. Everyone at Bell Sympatico next had replied that no one had authorizations to deal with any of the items, only Sasha Rollins did, and he never got back to me on them ever, even to date too.. 
     
    4: You Bell are also clearly guilty of forgery, lies, misleading, false business practices in that I HAD MANY TIME NOW HAD ASKED YOU FOR CONFIRMATION, PROOF THAT I HAD RENEWED THE SYMPATICO CONTRACT IN 2008 AND THAT I HAD REQUESTED ANY UPGRADES TO IT AND YOU DID NOT SUPPLY IT AT ALL. I IN 2008 WAS EVEN INITIALLY UNAWARE THERE WERE SYMPATICO CHANGES MADE, AND I WAS NOT TOLD BEFOREHAND, OR GIVEN THE PROOF THAT I HAD REQUESTED. I ALWAYS DO CONFIRM ALL AGREEMENTS WITH BELL SYMPATICO PREVIOUSLY IN WRITING BY EMAIL, AND YOU FORE SURE HAD NO SUCH LETTER FROM ME TOO.. I had rightfully as you are aware asked THE RCMP to investigate these matter in full too. if the contract was renewed by you NOW it should have been done at the old contract rates, and the promised 6 megs download speeds, and at the unlimited download as well. 
     
    5: I had also rightfully complained din writing many times about your false capping of my downloads without my knowledge , prior approval as well of my downloads on the unlimited Sympatico download contract. Presently I have an unlimited download contract with one of your competitors but they rightfully they do not cap my downloads per our present contract to o. 
     
    6: You Bell Sympatico had definitely many times now had unacceptably lied to me, had sent over 7 repairman to my home, had replaced my modem over 8 times as well, when you said that any of the problem of you failing to deliver me the reliable steady, continual high speed was related to me, my computer as well. I tested your system with 3 separate computers and operating system and it was your Bell line’s failure, Bells inadequate equipment, problems outside of my home that was the sole reasons of your own fault of past poor internet services to me. This all was also an unacceptable breach of the Sympatico contract towards me too. 
     
    8: I HAD NEVER NOW FROM BELL SYMPATICO REQUESTED ANY MODEM UPGRADE AND NEXT IN 2008 YOU HAD FALSELY CHARGED ME EXTRA FOR THIS AS WELL. YOU BUNCH OF LYING CROOKS HERE TOO.  
     
    9: Bell Sympatico you had tried to rob me of my monies now as well from my bank account in 2008 during the time I had been promised 6 month of Free internet services and those acts as well were, are totally despicable, immoral on your part too. 
     
    10 I WANT YOU BELL STILL ALSO TO DEAL WITH THE FALSE INVASIONS OF MY PRIVACY BY THE POSTING OF MY PERSONAL INFORMATION ON THE SYMPATICO CUSTOMER’S FORUM, AND I WANT YOU ALSO TO DEAL WITH THE FALSE CENSORSHIPS OF ME, THE FALSE ATTEMPT TO DENY MY FREEDOM OF SPEECH AND RIGHT TO BE HEARD ON THE SYMPATICO FORUM AND BY SASHA ROLLINS NOW AS WELL. NOW THAT IS JUST FOR A START..     Now the sole person who presently is authorized to deal with me regardying all of this, is the uless, no good, lying, pretentious Bell executive care Sasha Rollins, wjho has mailed me very similar useless response to my 300 deailed emails to him firstly. Please do note even spoecically the lastest one too date july 15, 2008..

     1: He Sasha Rollins says my complaints have been taken seriously and my email has been increased to 5000 letters a day.. he clearly now lies, this same when when undeniably this same liar had falsely disconnected my Bell internet service on June 1 2008 and had not reconnected it, and I thus now have no Bell Sympatico internet services.. so my Bell emails do not work at all. I have another ISP supplier instead now. This show how seriously he takes my letters, does not do an adequate review of them now eve firstly.

     

    2: He Sasha Rollins  lies and said he had promised me speeds up to 6 megs, that is like me fairly saying reciprocally I will pay him monthly up to 55 dollars per month as I see fit.. but up to contracts are illegal by the laws, courts  in the province of Quebec for they all  have to be of fixed, definable  values.
    3: He Sasha Rollins   says he credit my account with 6 months free internet, but that was not what we had agreed upon, a false credit, where he next lied and charged me for more extras as detailed many times.
    4: He Sasha Rollins  next  abuses me by referring to the city of LaSalle as being not responsible to return me any of the payments due to me, but  I have asked Bell in wrting to pay rightfully for their breach of my contract still too and many many many times.. and he even falsely had said he would not pay me..
    5: He Sasha Rollins  quotes inappropriate regulations that are not sanctioned by the courts now too justifying his false invasion of my privacy, slander, abuse of me, his and Bell lies to me, their breaches my  contract, his false capping of my downloads as well.. he also in writing  stupidly even threatens to terminate my Bell Sympatico internet services when the same definite fool, idiot should know I do not even have one the last 2 months with Bell Sympatico.
    He Sasha Rollins  said he took my complaints seriously.. what a liar he did not even address 99 percent of them firstly ..
    and next  I rightfully also still expect your clearly useless Conservative Minister of Consumer affairs Jim Prentice MP to rightfully deal with it immediately too.

    My past download and service problems with Bell Sympatico,

    I must say I am still rightfully really unhappy with my past years of experiences with my  Bell  Sympatico ISP services , their DSL Service and  DSL modem included.  I had joined  Bell Sympatico  because they  had advertised to me,  a high speed, unlisted, unlimited downloads and with no capping of their downloads. And had I known beforehand that I would have all of the many  unacceptable problems with them, and I would also also have their RATHER poor support on all of this  next to, plus their dishonest billing, management practices too, I really would not have bothered to GET THEIR  Internet services even  initially ..
     
     
    But the way the Bell customer support services tended to poorly handle my rightful complaints was ridiculous next as well. They had mislead me often as to what the real problem was, it was bad poor Bell itself, their inabilities  to meet theor own  promised contract terms.     I knew that there was something wrong with my Bell Sympatico ISP cause when I had started to measure it their internet download speeds and their the torrent download speeds fluctuated , were low and  the torrents were also capped by 90 percent   between peak times 4 pm till 2 am by Bell Sympatico  which was  all absurd,  the torrent download speed  was as slow as   15 kbs and not  rather what I had by Bell in  in the past of 250 to 350 kbs as well during peak hours. Bell for 6 months had lied to me and said the problems were related to my own computer and software when it next turns out undeniably this was never so too.  Bell Sympatico next  was unable in  18 months to resolve my problem, they replaced my modem 7 times, sent me 7 repairmen to my home as well.. and yet in one day my new ISP,  DSL supplier was able to resolve it.. Not only was Bell Sympatico  not delivering to me regularly their promised high speeds on their high speed internet, but I was also having major  internet connectivity site problems and email problems and too often, and I was unable to concurrently use my torrent downloads, email software, and my internet browser. It was all  getting to be so unacceptably absurd too. Bell wrongfully, clearly  had not lived up to it’s promised  contractual obligations.Bell Canada Inc. has been ordered to publicly disclose information that details the level of congestion on its network in regard to a dispute over the company’s internet speed-throttling practices.

    The Canadian Radio-television and Telecommunications Commission on Thursday told the company it has until June 23 to make public data that was marked confidential in a May 29 filing. Bell had said it needed to keep quiet the information, which details the level of internet traffic and possible congestion on its network, for competitive reasons.

    In a letter sent to Bell, CRTC director general of competition, costing and tariffs Paul Godin said the need for public disclosure outweighed the company’s competitive privacy concerns.

    “Commission staff has determined, based on all the material before it, that no specific direct harm would likely result from disclosure, or that the public interest in disclosure outweighs any specific direct harm that might result from disclosure,” he wrote. (link)

    Upon further advice from the net
    I set my Torrent  settings to:
    -16 kBps upload instead of 60 kbs or more
    -500 kbs (not unlimited download)
    -tcpip.sys patched to 50 connections
    -I do  have firewall disabled, 
    Now I’m even downloading with 400 kbs and yes… the torrents I do use are selected do have many seeds and few peers.. so I am sure I can reach the maximum speed.

    I like to use the torrent to download TV shows especially , I found TV shows often much better than the  movies, resolution included, plus on torrent downloads there generally are no COMMERCIAL interruptions,  and  I can chose when I want to watch the programs as well and this is why I basically do not want the cable TV instead.. I no longer watch my TV not even for the news.. since I also prefer to use the net for my news now too where I can get it at any time I want to  too..

    The MS operating system was  made for multitasking, even on the net, but with Bell Sympatico I clearly, wrongfully was unable to do this as well. Bell had even recommend that I shut down my  torrent software when I wanted to use my email or browse the internet. And  yes I too was really upset to find out that Bell was still capping my bit torrent downloads.. email, etc.,,

    Bell Sympatico had  falsely suspended my Internet contract recently to likely avoid a lawful  lawsuit from me. Instead now I find it ironic that Bell is being sued, Bell is facing a class action suit,  about the same time they Bell had falsely cut of my internet services,  with a Bell false excuse as well, Bell is being sued  by the others and they are asking for the same amount of money, damages that I  am personally asking them rightfully for too, about 2500 dollars specifically for Bell Sympatico’s  unacceptable breaches of my ISP contract obligations the last many years..     When I go public I often get threats of a lawsuit, not just the politicians sending the police to my door, but I do not back off, and I always seem to tell them to go ahead.. the lawsuit will give the matter more publicity too.. and they back off.

       

    Can anyone sue for defamation of character/libel/slander for PERSONAL statements made even on the Internet? But if it’s true there is no CASE for defamation or slander. And if it is NOT true they still will have to show specific, related proof of actual damages, not just some supposed potential damages. Furthermore the law still requires that they do reply to all allegations in the manner they had firstly have received them immediately too, within a reasonable period of time, and if they have not bothered to deny, reply to, to object any of the charges of wrong doings, allegations initially, after a reasonable period of time, a maximum of 6 months they not longer can do so, for now it is accepted they are true.

    Do ALL stop being sue crazy or nicky picky too.

    Because even many managers in Canada, the government too  are not honest, do not tell the truth, they often also do lie as to the actual reasons their product prices are going up, and/or the quality of their services are going down, thus they are still helping to put themselves out of work, out of business eventually and to be rightfully dismissed too.

    Recent discussions by both Bell and Rogers on their Corporate need  to get more and more money, with even any excuse, still out of consumers, and to throttle the downloads,  only all clearly confirms the reality as to how poorly managed these same companies in reality are still.. They too now have been wrongfully over subsidized by the CRTC, the Canadian  federal governments now too… now it is rather time the citizens got the break, protection.

    I have lived with Bell Sympatico DSL throttling for the past year. EVERY day from between 5pm and 2am these bastards throttled all P2P traffic ( including valid VPN apps, and other legit P2P, not just downloading random bit torrents etc. ) to 20 KBps max. Yes, that’s right, 20 to 30 KBps max for 9 hours every single day without fail. I could time when 2:02 am hit, then it would jump right back up to 500 KBps max downloading on my torrents.   Why didnt I switch ISP’s before this? Cuz my landlords paid a full year in advance for Sympatico DSL service to get “no monthly download caps”. So now the year is up, we have switched to www.yak.com, not only is it cheaper, it is truly unlimited with no monthly download caps. Now that Sympatico/Bell has been FORCED to stop throttling P2P/encrypted traffic with this class action lawsuit, all 3rd party ISP’s that buy off Bell’s DSL backbone no longer have problems with their damn throttling either!! $35/month including DSL modem rental, monthly fee ( you dont have to sign up for 1 , 2, or 3 year contract like you do with Sympatico ), so $10 cheaper and no over usage download fees..    I friggin HATE Sympatico, and to a lesser extent Rogers.. although Rogers learned their lesson and doesnt throttle torrents anymore.. my buddy gets 800 KBps P2P download speed all the time lately… good…”  http://www.xbitlabs.com/forum/viewtopic.php?p=201335&sid=3acea536c8fac131f24d931f49295da5

    L’Union des Consommateurs and a Quebec consumer have launched a class action lawsuit against Bell Canada over its throttling practices.  The suit, which is seeking certification on behalf of all provincial subscribers, argues that the practices deliberately slowed consumer services and raises privacy issues.  It seeks a refund of 80 percent of the monthly subscription price, in line with the reduction in advertised speeds.  It further seeks $600 per subscriber to compensate for false advertising and $1500 for privacy rights violations. A Quebec group called L’Union des consommateurs, along with Bell customer Myrna Raphael, are accusing Bell of false advertising, as a result of its practice of throttling traffic at peak hours. Raphael is said to have signed a three-year ADSL contract in 2006, partly on the basis of Bell’s claim of “constant speed” at all times; by enabling throttling last fall, says Raphael, Bell broke its agreement.  Bell is further accused of violating users’ privacy, by using a technology called deep packet inspection (DPI) as part of the throttling process. Although DPI may be used for beneficial purposes, such as the control of spam, viruses and hacking, it has also been implicated in more sinister uses such as censorship, net neutrality violations, and government spying in countries like China and the  US

    Consumers have come together in Canada in a class action lawsuit against Bell Canada for the company’s practice of throttling traffic. There are two charges involved in the lawsuit. The first is for false advertising; the company had advertised the offer of a constant speed at all times which isn’t true if throttling is going on. And the second is for violating users’ privacy through the use of deep packet inspection. Those filing the suit say that the ISP throttles about eighty percent of the time and they are therefore seeking a return of eighty percent of the customers’ monthly subscriptions along with additional fees for each of the two violations. It’s only in Quebec, because it’s a Civil case, which is not possible outside of Quebec in Canada.  Quebec has a completely different legal system than the rest of Canada and the US. Only for civil cases, not criminal cases. Criminal code is uniform throughout Canada   The rest of Canada and the United States is derived from English Common Law. Quebec is derived from Code Napoleon. This is the same province who’s judges just re-wrote the interpretation of law (in the opinion of the majority of legal opinions) with the court of appeal’s overturning of a lower court ruling about BCE bondholders and the pending takeover of the company by OTPP. We’ll see how the Supreme Court goes on that one, but never underestimate the Quebec court system’s ability to interpret the law in new and interesting ways –About Class Action Lawsuits in Canada  A class action allows one person, called a representative plaintiff, to start a lawsuit on behalf of himself/herself as well as all others who fit into the defined class, subject to the rights of class members to withdraw or opt-out. This means that a single person can commence a class action on behalf of hundreds or thousands of people. Ontario, British Columbia, Quebec, Saskatchewan and Newfoundland are the only five provinces in Canada with Class Action Legislation in effect.     Bell is not the only internet service provider to throttle customers speeds, as Toronto-based Rogers Communications Inc. has acknowledged doing so. A spokesman for Bell’s main competitor in Quebec, Montreal-based cable provider Vidéotron Ltée, said it does not throttle its customers. The union, however, also launched a class-action lawsuit against Vidéotron last year for forcing download limits on internet customers in the middle of their contracts. The company said it was not violating the terms of those contracts as it gave customers two months warning. The CRTC has given interested parties until June 12 to make their submissions on the throttling issue. Bell will then have until June 19 to reply to those submissions, while CAIP will have until June 26. The CRTC said it will then make a ruling by September. Aside from the Quebec consumers’ lawsuit and the CRTC probe, Bell also has to deal with a complaint filed with the federal privacy commissioner by the Canadian Internet Policy and Public Interest Clinic, a University of Ottawa legal clinic specializing in internet and other technology-related law.     Dirty Dirty Bell Sympatico

    Bell Sympatico wrongfully had cut of my internet services last month cause they had wrongfully objected to my rightful complaints and me also going public about it world wide.. I next got a cheaper service at 1/5 the cost from Bell from another firm, that ironically still gives me the same service even from Bell that I had before.. so they Bell  had meant it for evil but it next had caused me to save loads of money instead.

    I HAVE HAD IN CANADA IN THE LAST 25 YEARS WHICH IS OFTEN A POLICE STATE THE POLICE COME TO MY HOME 6 TIMES BECAUSE OF SOMETHING I HAD WRITTEN TO THE NEWS EDITORS WITH A COPY TO THE MAYOR, PREMIER, PRIME MINISTER, AND IT WAS ALL A FALSE, CLEAR ATTEMPT TO OF OBSTRUCTION FO JUSTICE, FALSE SUPPRESSIONS  AND HARASSMENT, BUT I AM STILL OPENLY WRITING TOO. all it takes for the evil persons to persons is for the good person to falsely give in to the wicked, who do not like their negative truth exposed of course.. and crooked pastor snow are no different.. 3 separate bad pastors have tried to kick me out of their churches and WERE AS A DIRECT RESULT FORCED TO RESIGN NEXT STILL TOO.     Imagine that Bell has been in Business for many years and is still guilty now clearly of misleading advertisements, fraudulent and unacceptable business practices, not living up to their contractual obligations, as I now have PERSONALLY WITNESSED, EXPERIENCED  and undeniably detailed to even Bell and many others many times too now . I Paid for a high speed unlimited download service but that is not what I got next. I got low internet speed at a high price. With Bell you have to check your actual delivered speeds , “internet download and upload speed test” cause Bell seems to change it to suit themselves..  (Presently I am with Acanac Inc. http://www.acanac.ca 1-866-281-3538, and do  see their speed test too).

    “Poor quality of Sympatico internet service -I have been a Sympatico customer for about 10 months now and haven’t had any problems up until the beginning of December.
    Up until that point I was able to access any web pages I wished with no lag or problems and I was also able to download files with no problems at a good speed.
    I then started noticing that my web pages were taking a long time to load and that files were taking a long time to download so I decided to to a speed test. The results of the speed test revealed that my download rate was below 200 kbps and my upload speeds were double my download speed. I tried this on my second computer and got the same results.
    I knew right away that there was a problem after seeing this so I called the Sympatico tech support. They had me do all sorts of different things on my computer to see if they could get it back to speed and nothing helped.
     
    After over an hour of doing everything they asked of me they told me that there must be a problem with my computer.
     
    As a computer technician myself I told them that nothing was wrong and that I had already checked the computer for any possible viruses, adware, spyware, etc.
     
    The tech put me on hold for about 15 minutes and came back and said that they tested my line and they have a crystal clear connection so I should be getting around 2.4 Mbps download speeds and since I’m not it has to be a problem with my computer. I told them that that is unlikely since I have 2 computers and the results are the same on both. The tech told me that there was nothing else they could do and insisted that nothing was wrong on their end. I was extremely frustrated since I spent about an hour and a half on the phone with them and got no where . Frustrated with their answer I decided to get a laptop from work and did the speed test on it, and I was not surprised to see the same results. A friend of mine also had a spare DSL modem so I borrowed it to see if it was a problem with my modem and his modem didn’t change anything either. I called tech support a second time and explained that I have tried 3 different computers and and a different modem I get the same results with all of them. They put me on hold again and said that everything tests out ok and that I am getting a connection speed of 2.4 Mbps. No matter what I told the tech on the phone he insisted that I was getting that speed and that there was something wrong on my end. I was getting more and more frustrated the more I spoke to the tech so I asked to speak to the supervisor. The supervisor told me that he was going to run some tests on my line and call me back the next business day. The supervisor called me back later that day and left me a message that he made some changes to the line and that he would still call me back to see if it helped. I did the speed test again and nothing was changed. I called them back a few days later since the supervisor didn’t call and when I called again I got the same story again about there being nothing wrong from their side. They had me do the same tests for the 3rd time and in the end they once again said there was nothing wrong. Frustrated again I asked to talk to a supervisor and after spending about a half hour talking to this supervisor he decided to send me a new modem even after I told him I tried that. When the new modem arrived I tried it out and did the speed test and just as I suspected got the same results. I called tech support again and explained that it has been 3 weeks now and I’ve tried everything I can so it has to be something to do with them. They told me there was nothing wrong so for a 3rd time I spoke to a supervisor and he said everything was fine and that there was nothing they could do (sounds like a broke record doesn’t it?) . A friend of a mine upon speaking to one his friends that owns an ISP in our city, he found out that he has been fighting with Bell to fix the exact same problem in my area which had something to do with Bell’s equipment. By this point after calling Bell 6 times and getting nowhere I have had enough and called to cancel my account with them. They told me I was in a contract and that I would have to pay a $200 penalty to get out of the contract. I explained the whole situation and why I wanted to cancel and they told me that I had to exhaust one last before they can waive the $200 fee. They said I had to call the “Get connected” team and that a group of experts would have to look at it and if they couldn’t fix it then they would waive the fee. I called this so called team of experts and found out that they are the same people I have been calling all along so they deemed my problem unrepairable and that they would put that in the ticket but since the business office was closed that I would have to call back the next day to cancel my account. The next day I called and the person I spoke to said that I can’t cancel since I was in a contract. I explained to them what the person said the previous day and they told me that that person shouldn’t have said that. I told him that I would have no problems staying in the contract if they would offer the service they said they would when I signed it. They told me that they don’t guarantee any download speeds all they guarantee is that I have a connection which I did. Steaming mad at this point I told them to send out a technician to my house because there was something wrong that they needed to fix. After putting me on hold again for 15 minutes they told me they were going to send out a tech. That night just to be sure I took my computer over to a friends house that also has sympatico and I was able to get full download speeds on his connection so I was sure it wasn’t my computer. I again tried it on my connection when I got my computer back home and had slow speeds as usual. The next morning I tried it again and surprisingly it was fixed!!!! I spoke to my friend and he informed me that his friend that owned the ISP said that Bell had fixed a problem with one of their switches and in turn that fixed my problem. I wasn’t surprised to hear that something that Bell fixed with their equipment fixed my problem since that is what I had been telling them all along. I spent well over 8 hours calling Bell, working on my computer, checking cables, and testing and 4 weeks of poor quality internet service to find out what I had been telling them all along, that it was a problem they had to fix.
     
     All I can say that when my contract is over I’m done with Bell, they have not respect for their customers and until they do I don’t want to do business with them.
    If you only read one line of this I hope that its this: DON’T DO ANY BUSINESS WITH BELL UNLESS ABSOLUTELY NECESSARY!!! THEY DON’T VALUE THEIR CUSTOMERS WHAT SO EVER.

    I have been with Sympatico for about 7 years, and I went up the line from dial up to high speed and up until Aug. 07, everything was great! I was billed as High Speed (not Ultra) with Unlimited up and download, well, they fixed that, prime time, I was only getting a max of 30 Kbs/per sec. But for those that are up nights the service would be great because about midnight you would get the speed you paid for. I understand that one day there is going to be a back log in service, but don’t have innocent people lie to their customers saying its the customers computer and have them spend hours unplugging this and that, try this and that! Don’t call tech support! The only thing they support is the Author of the instruction manual they are reading from! I have paid since Aug. 07 for a service I was promised and never received and if I had the nerve…I’d take them to Small Claims Court to get my money back!
    For those of you looking for a service, choose wisely (I now have cable high speed)! For those of you that ONLY HAVE ONE CHOICE…GOOD LUCK WITH IT! Don’t be shy, complaining WILL get you SOME satisfaction.”

    FOLLOW UP ON BELL SYMPATICO

    You get what you hire, pay for, and all that glitters is not gold. Now for about 16 months I have dealt both with the clearly, pretentious  inadequate Bell tech support mostly  in India, and  the too often useless, pretentious Bell Accounting Billing now too.
     
    Attention: Bell executive Care, Bell billing- accounting,  and Bell’s Sasha Rollins-  May 6, 2008,  Letter # 278
     
    My bad Bell internet system was totally down even 3 days two weeks ago, it is totally down again today **, and you did not even credit me for any of this, but Bell next still phones me again today and demands my payment still. Unbelievable and ridiculous. You have mislead me in your advertising for your Bell Internet service works adequately only one week in four in the last 9 months in my direct personal Bell experience now too. Your Bell support services too often do not even do that now as well.  No doubt about it that Bell has lied and over advertised it’s capability, reliability, services too even to me. Unacceptable.
     
     I was still very surprised next when you even wrote to me last week to  tell me  even as to how many letters I can send,  and what also to whom? and what I could and could not write about Bad  Bell  in my emails?  and what next you also will want to write my emails of me too?  Absurdity for you to demand any of this from me  for  are really falsely dreaming..  But now next  Bell  itself can phone me today again, this afternoon and harasses me for more payments for more of Bell’s breach of contract. This is still unacceptable harassment of me again and absurdity too that all can see. This Unauthorized Bell watchdog needs to firstly look at itself and deal rightfully even firstly with it’s much too many customer contract violations, abuses, and ASAP even in reality. When I called back Bell I often have to wait  a long time and next because they  had  even disconnected me, hanged up on me, pr promise to call back  and no one at Bell next had even called me back as Bell had promised to do so again even  today. I get a still bad service from you..  Contract obligations wrongfully are solely one way with Bell, I pay and you provide a poor service.
     
    As posted on the net the Bell supervisor had promised me last week that my complaints would be all fully investigated, adequately dealt with and no one will trouble me from Bell now next too. I got that in writing too

    But now today this afternoon I next still just got another unacceptable harassing computer phone call from Bell’s Billing, who in their one sided greedy pursuit of the contractual obligations, falsely overlook the fact when Bell they firstly they did not keep my side of the contract  as my many letters that you admit in writing to me that you have received now where I  have detailed, that I specially had not requested or authorized any internet upgrades, changes in 2008 nor had I requested any modem upgrades but yet I was charged for this, and I objected to all of this and I had asked you many times to  rightfully  take this of my bill but you wrongfully did not.. You have no proof that I in writing I had authorized these changes too. So the really crappy Bell does not deal with my posted complaints to them but they want to harass me again with phone calls for  my money.. Deal with all my complaints firstly if you want to  be paid for anything! Deal with your false breach of my contract obligations now too, and my requested payments for my bad services, problems now from Bell too.
     
    Rightfully Stop now these harassing Bell phone calls too. Now RSVP ASAP and deal adequately with all of my complaints now to you too , thank you. Unless you still lido want everyone to get much more emails ?

    ** 2 WEEKS AGO I HAD THE SAME  NON WORKING INTERNET PROBLEM I HAD TODAY AND MANY TIMES BEFORE.. BECAUSE THOSE USELESS TECH NERDS IN INDIA WOULD LIE TO ME AND SAY THE PROBLEM IS EITHER A DEFECTIVE MODEM this is my second 2 wire modem now too,   or  they say the problem is the customer’s  computer cache , VIRUS, SPYWARE, AND NOT at all BELL ITSELF.  At my own insistence a  more detailed  INVESTIGATION into the matter was made  next  BY BELL’S CANADIAN TECH NERD IN NEW BRUNSWICK which RATHER REVEALED THAT it turns out that FIRSTLY the Bell INTERNET SERVICE itself was was down, and in the process THE RESTART NEXT  reboots each of  the customer’s 2 wire modem, and the reboot next would not accept many of the user’s existing password unless one letter at least was in upper case, a common knowledge only to a few at Bell but not to most of the customers, and not the  rest of the Bell support personnel, especially in India  sadly. So Bell you have bad telephone lines, and bad equipment  and clearly ignorant, bad Bell techs making it all worse ehh? Those much to many Bell liars in India tend to falsely blame the customer too often.. not their own tech ignorance,

      I was still very surprised next when a person from Bell now even wrote to me to  tell me  even what I could and could not write to them in my emails and also how many letters now even too .. for they are dreaming.. dreaming absurdities.. what about some real repentance from them firstly for their own clearly unacceptable, undeniable poor and immoral acts firstly and rightfully still too. Who does he think he is? I know what he is, an abuser  still, an unacceptable bully too!!
     
    Bell has often itself found a an excuse for not performing a specific job assigned to them under the  contract agreement but fooled few in the process now too as to how really immoral Bell was, is  and that includes their false capping, terminations of the customers unlimited downloads now too..
     
    One side breaching a contract is a common, often fact of life, very common, and it happens often in in the Computer business, with Internet Service Providers, in  Real estate and even with new home contractors now as well sadly,  and I  have often witnessed it myself.. and pretentious self regulating boards, governments  are mostly useless too, and it is basically too costly to get a lawyer, it only makes the lawyer’s richer, so now the best way to deal with any breach of contract  is to  expose the bad guys to all, to the news media  and thus really put them out of business.. and I have done that even with a large major corporation successfully before now too..

    The ISP wrongfully sees itself as the sole judge of disputes in their contract obligations too. This sort of contract, where the subscriber is considered to agree by signing up for service rather than by active negotiation, is given extra scrutiny by the courts. Any wiggle room or ambiguity is usually resolved in favor of the consumer rather than the company.
     
    Even in the US the Bells are losing heavily to the Cable guys, who are bleeding them to death next too,  and in desperations  the Bells are  looking for any other possible sources of revenues..   But had they not abused, screwed their customers so often, the customers would not have so readily transferred to the cable ISPs. When the past Bells customers do  transfer to cable  they take not just their internet services es but their phone lines and next they rarely come back to the Bells too.. and the Bells revenues go down seriously. “ Posted on by marksy Well here again I sit and write about a multi-billion dollar corporation screwing its’ customers any way and every way it can.  This time it is the god of phones, Bell Canada….  led me to what probably amounted to my 15th – 20th phone call in the last 2-3 months.”
      
    Courts Turn Against Abusive Contracts “In the past month, however, two new US court rulings suggest that judges are developing a more sophisticated sense of how corporations conduct online and technology transactions with their customers that Bell Sympatico especially now needs to note. “The EULAs or terms-of-service agreements are long and legalistic, the deals are offered on a take-it-or-leave-it basis and the terms are often oppressive and one-sided. As a result, the legal hegemony of the EULA is cracking. This is a good development for consumers, who would otherwise be saddled by oppressive terms they have neither the legal sophistication to understand nor the bargaining power to avoid, and for the public interest, which suffers when customers are forced to waive rights that capitalist democracies rely on for innovation and accountability.In Gatton v. T-Mobile (.pdf), the California Court of Appeal struck down a provision in the mobile phone company’s EULA requiring consumers to go through arbitration to challenge termination fees or the practice of selling locked handsets that can’t switch carriers with the customer. The court held that both the way customers entered into the EULA contract, and the arbitration terms of that contract, were unconscionable, and therefore the provision would not be enforced.The reasons the court gave for holding the EULA procedurally unconscionable apply to most EULAs. Even though the arbitration term was fully disclosed to consumers, the contract was one of “adhesion”: an agreement imposed and drafted by the party with superior bargaining strength, which gave the consumer only the opportunity to accept or reject the contract, not to freely negotiate it. As a result, the customer’s unequal bargaining power results in an absence of meaningful choice. The fact that the customers could choose a different carrier may mitigate, but not cure, the procedural unconscionability.Gatton is an important case because it recognizes that every clickwrap, shrink-wrap, browsewrap and box-wrap contract has an element of procedural unconscionability that requires the court to consider whether the challenged term of the contract is overly harsh or one-sided. This opens up the content of contracts to legal supervision, which is great in a situation where the customer hasn’t really been able to bargain, negotiate or otherwise exercise market power.  But in  unacceptable direct contrast the now  recived, mailed  statements for the subsequent months for the monthly high speed unlimited  internet billing statements  are not at all similar, not even as simple, but unacceptably they are unacceptably distorted still, confusing , full of unacceptable irregularities, unacceptable extra charges  now next.. that I unacceptably have many time now asked you by phone, in writing to rightfully deal with and correct. Amongst my many other rightul demands to you too now. IT IS SHEER UNACCEPTABLE  STUPIDITY, DISSERVICE ON YOUR PART THAT I HAVE EVEN TO TALK TO YOU ABOUT THIS FOR MONTHS TOO. My monthly high speed unlimited  internet billing statement  for  February 2008  firstly  do not show any services and equipment charges, etc, at all , note none  at all,  but unacceptable in March  2008 Bell  shows me  some new, unacceptable different services and unacceptable  equipment  charges of $103.90 and next  the other charges  of 286.97 .

    Please note I today by mail  have received your unofficial  my monthly high speed unlimited  internet billing statements from you for the last 6 months unsigned and incomplete firstly, so how can you EVEN expect rightfully now for me to pay you when you cannot delievr what I have asked the last 6 weeks to me in this? On top of that while the statements for November 2007, December 2007 and January 2008 monthly high speed unlimited  internet billing statement showing a total service charge of  54.13 for January 2008 were paid for and they are all very clear, satisfactory. 

    AND I HAVE ALREADY DETAILED MY OBJECTIONS TO THESE UNACCEPTABLE AND UNSPECIFIED CHARGES, AND WHAT TO KNOW AS TO WHAT ACCOUNT THESE CHARGES WERE APPLIED TOO NOW TOO?

    I also do rightfully think it’s really reprehensible that Bell, etc., had now  advertised unlimited download service and then next complain when you actually take them up on their offer. If a user wants to take full advantage of the service they pay for, they should be entitled to it by law now too.  Still  if they’re unwilling to provide the bandwidth I pay for, during the full duration that I pay for it, then they shouldn’t have been be telling me they can.     No large corporation, with almost infinite legal resources and billions of dollars behind them, should be able to use their wealth to put real people at a disadvantage, because it would be presumed that only the corporations   had any legal rights.   Bell included now.
         
    What started as a simple phone call by me in January 2007 to Bell tech help line to determine why my internet services were so slow and sluggish next had  become a major farce, cover-up on the part of Bell Sympatico. I was next lied to for months as to the real reasons Bell they rather had offered me their poor internet services to me and  to many others in my city for years now too.. and then Bell had even  lied to me some more, had also breached their contractual obligations to me many times too, had allowed me even to be slandered, abused on the Bell customer forums now too.. and why? so  that clearly greedy Bell can continue stay in business to make more money.. and so who really cares now about the customer’s good welfare in reality? now? What not Bell itself, not the CRTC, not the federal government, not our Prime Minister Stephen Harper, not  the the federal Minister of Consumer Affairs, Jim Prentice..  not  any provincial consumer affairs Minister, but only the citizens, the news media, and the NDP party care about the citizens  good welfare really it seems.     Why does it take months to reply to me on my simple issues too.  I keep on getting transferred also to invalid persons, telephone numbers at Bell Executive care even today.. and no call backs still too Supervisor Mrs Fernandez  RSVP ASAP
      
    Bell’s Useless Supervisor Mrs Fernandez of Bell’s useless Sasha Rollins does even needs to be replaced now too . Immediately..

    PS I have sent you over 150 emails of complaints too, that you have not addressed and also you did  not return my many phone calls..  why?? you only lie when you say that the customer’s concerns, complaints are of interest to you..
     
    So I ALSO AM NOW ASKING  1000 dollars, and also rightfully increase a demand from 6 months to one year free unlimited high speed internet services from Bell, if they do continue to trouble me on all of this, my rightfully payment for all of the unacceptable aggravations, and their clear failure still to meet the contract agreement, for Bell they ARE GUILTY OF contract breach definitely.

    Recent discussions by both Bell and Rogers on their Corporate need  to get more and more money, with even any excuse, still out of consumers, and to throttle the downloads,  only all clearly confirms the reality as to how poorly managed these same companies in reality are still.. They too now have been wrongfully over subsidized by the CRTC, the Canadian  federal governments now too… now it is rather time the citizens got the break, protection.
